Terms of Service

1. Acceptance of Terms

By accessing or using the Talented platform (the "Platform"), available at talented.in and its associated mobile applications, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Platform.

The Platform is operated by ConsortX ("we", "us", "our"), a company registered in India. By using our services, you confirm that you have read, understood, and agreed to these Terms along with our Privacy Policy and Refund Policy.

2. Definitions

• "Platform" refers to the Talented website, mobile applications, and all related services.
• "User" means any person who accesses or uses the Platform, including students, parents, school coordinators, and visitors.
• "Student" means a user registered to participate in competitions and quizzes.
• "School" means an educational institution registered on the Platform through a coordinator account.
• "Competition" means any quiz, talent competition, or event hosted on the Platform.
• "Content" means any text, images, audio, video, or other material uploaded to or generated by the Platform.

3. Eligibility

The Platform is designed for students from Classes 1 to 12 studying in recognised schools across India. To use the Platform:

• Students under the age of 18 must have the consent of a parent or legal guardian to create an account and participate in competitions.
• School coordinators must be authorised representatives of their respective educational institutions.
• Users must provide accurate and truthful information during registration, including their real name, class, and school details.
• We reserve the right to verify the identity and eligibility of any user at any time.

4. User Accounts

To participate in competitions, you must create an account. You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activities that occur under your account.
• Notifying us immediately of any unauthorised use of your account at support@talented.in.

We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in fraudulent activity.

5. Competitions & Quizzes

The Platform hosts two primary types of competitions:

• Quiz Competitions: Timed, multiple-choice assessments across academic and general knowledge categories. Results are determined by accuracy and time taken.
• Talent Competitions: Creative submissions (singing, calligraphy, storytelling, Quran recitation, etc.) evaluated by expert jury panels.

By participating, you agree to:

• Follow all competition rules as specified on the competition detail page.
• Not use any unfair means, including but not limited to copying, using external aids during timed quizzes, or submitting plagiarised content.
• Accept the results and jury decisions as final. While we strive for fairness, decisions made by our scoring systems and jury panels are not subject to appeal.
• Understand that prizes, certificates, and recognition are subject to eligibility verification.

6. Payments & Refunds

Certain competitions and school registrations require a fee. All payments are processed securely through Razorpay, our authorised payment gateway.

• All fees are listed in Indian Rupees (₹) and include applicable taxes.
• Payment must be completed before participation is confirmed.
• We do not store your credit/debit card details. All payment data is handled by Razorpay in compliance with PCI DSS standards.

7. User Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable Indian law.
• Attempt to gain unauthorised access to any part of the Platform, other users' accounts, or our servers.
• Upload or transmit any harmful, offensive, defamatory, or obscene content.
• Use automated scripts, bots, or other tools to interact with the Platform.
• Impersonate another user, school, or organisation.
• Engage in any activity that disrupts or interferes with the Platform's operation.

8. Intellectual Property

All content on the Platform — including but not limited to text, graphics, logos, icons, images, audio clips, quiz questions, competition designs, and software — is the property of ConsortX or its content suppliers and is protected by Indian and international copyright laws.

You may not reproduce, distribute, modify, or create derivative works from any Platform content without prior written consent from ConsortX.

For talent competitions, you retain ownership of your submitted content. However, by submitting, you grant Talented a non-exclusive, royalty-free, worldwide licence to use, display, and distribute your submission for promotional and educational purposes.

9. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms. By using the Platform, you consent to the collection and use of your information as described therein.

10. Disclaimers

The Platform is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding:

• The accuracy or completeness of quiz questions, competition results, or leaderboard rankings.
• Uninterrupted, error-free, or secure operation of the Platform.
• The quality or suitability of the Platform for any particular purpose.

11. Limitation of Liability

To the maximum extent permitted by Indian law, ConsortX and its directors, employees, partners, and affiliates shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
• Loss of data, profits, or goodwill.
• Any damages resulting from unauthorised access to your account.
• Technical failures, server downtime, or connectivity issues during competitions.

Our total liability for any claim arising from or related to these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim, or ₹1,000, whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless ConsortX, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, with or without notice. Upon termination:

• Your right to use the Platform ceases immediately.
• Any pending competition entries may be forfeited.
• We may retain your data as required by law or for legitimate business purposes.

You may also delete your account at any time by contacting us at support@talented.in.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Platform. Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Hyderabad, Telangana, India.

This agreement is governed by the Information Technology Act, 2000 and the rules made thereunder, as applicable to websites and mobile applications operating in India.
